the photo of Harry in the kill room heavily suggests that The Brain Surgeon is indeed still alive and kicking. The person in the far right photo is Lyle Sussman from episode 2. The one that was held at gunpoint to kill another person and was later found dead at his cabin. Vogel's funeral is apparently in episode 11 so Brain surgeon is either her or she gets killed by him. Yay for larger images!
I wouldn't be so sure. Yates had no idea who Dexter was, couldn't even say his name. (The Brian Surgeon sent the first piece to Vogal wrapped in "Butcher Paper"...)His rage made him not "precise" enough to cut away a certain pieces of brain that send specific messages to them...
